Are you feeling overwhelmed & confused by EHS regulations & struggling to find a solution?

If so, don’t feel bad because you’re definitely not alone.

These regulations are extensive, complex, hard to understand, ever-changing and even tougher to comply with especially for small manufacturers who almost always lack the expertise, time & resources needed to keep up.

Regardless of these challenges, compliance is a priority you cannot ignore......

Does any of this sound familiar?

  • Not knowing which OSHA & EPA regulations apply to your company

  • Living in constant fear of a failed OSHA or EPA inspection

  • Worrying about serious employee injuries & accidents

  • Losing business opportunities due to lack of a safety program

  • Lacking the expertise, time & resources needed to manage compliance

  • Repeated failed efforts to manage EHS compliance

  • Lacking budget to hire a qualified EHS manager or expensive consultant

  • Not knowing where to turn for affordable compliance help

Failure To Manage EHS Puts Your Company At Risk For Major Liabilities Including:

  • Regulatory fines that can run into the $10's or even $100’s of thousands of dollars

  • Potential civil and criminal liability for ownership & management

  • Serious employee injuries and even fatalities

  • Company reputation damage and public relations problems

  • Lost customers and business opportunities

  • Increased costs and wasted money

Meet Russell Carr

Founder of Berg Compliance Solutions and EHS Academy: Small Business EHS Compliance Advocate and Expert

I understand your compliance struggles all too well because I owned and operated three small, high risk companies with major environmental, health and safety obligations.

Between the three companies, I had to manage OSHA, EPA, TCEQ, and DOT regulations. It was overwhelming and I always struggled to keep up which lead to all kinds of problems including fines, lost business opportunities , wasted money and many sleepless nights.

One of the things I learned was that I wasn't alone. I saw many other small companies and people throughout my career also struggle and pay the price for failing to manage EHS including huge fines, PR nightmares and even jail time.

Most of these stories impacted small manufacturers, a sector I've supported for over 23 years.

These experiences later inspired me to found Berg Compliance Solutions & EHS Academy, both dedicated to helping small manufacturing & industrial facilities manage EHS compliance & risk.

"I created GUIDED COMPLIANCE to help small, resource strapped manufacturing & industrial achieve compliance and risk reduction in the most effective, comprehensive and affordable way possible"

Here's how GUIDED COMPLIANCE is different than traditional consulting and why it works so well...

The "Old" Way vs. The "New" Way

  • The "Old" Way ("Outsource" EHS)- Traditional "done-for-you" consulting consists of turn-key, on-site services delivered by an expert consultant who manages everything on behalf of the customer. We've been deploying this model for years with great success, however the major disadvantage is that the customer often ends up becoming dependent on the consultant because they never learn or understand the compliance process. This dependency and lack of understanding prevents the customer from ever "owning" or self-managing the process, so if the consulting service ends the EHS program quickly falls apart.

  • The "New" Way ("Own" EHS) - Guided Compliance is a revolutionary new virtual consulting approach which focuses on training your staff on the regulations and how to manage them in a way that non-experts can easily understand and follow. Guided Compliance removes the complexity from OSHA & EPA so that your team is able to "self-manage" and "own" the compliance process over time. This is the best way to help ensure long term EHS program success & provides the first-ever affordable & viable "Do It Yourself" option for small manufacturers wanting to manage EHS compliance in-house.

How Does It Work?

  • General Approach & Principals:

  • Ongoing Virtual Consultation From Our Team of EHS Experts- We are there to guide and answer your questions every step of the way during weekly group calls and community Q&A board. Think of us as your virtual EHS management team.

  • Our Proven & Predictable Process - GUIDED COMPLIANCE is based on the same proven and predictable process that we've been using for many years to help small manufacturers achieve EHS compliance

  • One Step At A Time - The program starts with OSHA health and safety compliance, and for interested customers transitions to EPA & state environmental compliance with purchase of add-on training program (coming soon)

  • The Nuts and Bolts

  • The #1 Reason That EHS Programs Fail is Due to Lack of "Management Commitment" - We start the program by training your team how to build that "top-down" commitment & safety culture to create the foundations for long term success

  • Together We Build Your Customized EHS Program From Scratch - We train your team how to determine which OSHA & EPA regulations apply to your company so you can build a customized program to meet those requirements and achieve compliance

  • EHS Committee Model - Every successful EHS program relies on a committed team for success. Our program is based on this model because it's proven to work and allows for allocation of responsibilities which is critical for success in a small manufacturing environment

  • Your Team Learns How To Self-Manage Your EHS Program Forever - Once your program is built, now it's time to move into management mode. We train your team how to do this using our proprietary management tools, so you can "own the process" moving forward which is the key to long term success

It's Time To Make a Decision and You Have 3 Options...

  • Option One

Do nothing and keep rolling the dice with non-compliance

As mentioned above, compliance is a priority you cannot ignore.

The risks for failing to manage EHS compliance can be devastating including huge fines, potential civil and criminal liability, not to mention serious employee injuries and damage to your local community and the environment.

The majority of our clients come to us only after something bad has happened .

Be proactive and avoid the risk.

  • Option Two

Try to develop and manage your EHS program in-house

This is a risky and often ineffective option for many reasons.

The fact is that most small companies simply lack the internal expertise, time and resources that are needed to develop a compliant EHS program without serious help.

The process normally involves tapping unqualified staff, on top of their other responsibilities. They're often given little if any guidance and are expected to research on-line, buy some generic resources and then "magically" create and manage an EHS program.

This approach is doomed to failure and leaves the company in a perpetual state of non-compliance and at elevated risk for significant liabilities.

  • Option Three

Enroll in our program to finally achieve EHS compliance and reduce your risk

Our training program is specifically designed to meet the EHS compliance challenges facing small manufacturing & industrial processing companies and is the only viable DIY solution on the market.

Our program & team of experts will guide your staff through the process of building a customized and compliant EHS program from scratch using our proven, predictable and proprietary process.

Together, we’ll determine which regulations apply to your business & develop a customized plan to achieve & manage EHS compliance to ensure a safer and healthier workplace for your employees, local community and the environment.

Are You Still Unsure?

Checkout our Frequently Asked Questions

  • How much can a failed OSHA or EPA inspection cost?

The average failed OSHA inspection will cost a company between $35,000 - $90,000, but can exceed $100,000 or more in many cases. EPA and state environmental fines can also run into the $10s or $100s of thousands of dollars because they're not capped, and fines can be issued for every day that the company was out of compliance.
 COULD YOUR COMPANY AFFORD THIS?

  • Can ownership and management face criminal liability for failing to manage compliance?

Unfortunately the answer is "yes" in cases where company leadership are aware of hazards or major risks, but fail to action which results in fatalities or serious damage to the environment.

  • Can OSHA or EPA fine our company even if we only have a few employees?

Absolutely. OSHA & EPA routinely fine small companies with less than 10 employees.

  • Can we outsource our OSHA compliance to our insurance company?

No. This one of the most common myths surrounding OSHA compliance. It is impossible for your insurance company (Workers Comp carrier) to manage your safety program because they have no mandate to do this, lack the bandwidth to manage OSHA compliance for any single policy holder, and can only offer generic resources which don't meet OSHA standards.

  • How do we determine which environmental, health and safety laws apply to our company?

Your company must assess its operations to determine which EHS regulations apply. Each company has a very unique set of hazards and risks which must then be managed by applicable OSHA, EPA & state environmental regulations.

  • Are we compliant if we have a written safety manual?

Not necessarily. Just having a written OSHA compliance manual doesn't equal compliance. First of all, the manual must be customized to address your company specific health & safety hazards, and there are also many aspects that the company must actively manage including training, inspections, procedures, exposure evaluations and more.

  • Does generic on-line or CD training meet OSHA and EPA standards?

No. All employee training must include and address your company specific health and safety hazards and requirements. No generic training resources meet these standards.

  • How long does it take to build a safety program?

It depends on the size of your company and your operations, but if you follow our schedule & recommendations, your safety program should be built within 6 months and then you'll transition to "management mode." We recommend building 1-2 components each month, so that the program is manageable for your team.

  • What if we don't have any safety experience??

No problem, our program is built for "non safety experts!" GUIDED COMPLIANCE removes the complexity from OSHA compliance so your team can build & manage a safety program even if you know nothing safety

Here Are The Results & Outcomes You Can Expect:

  • Be prepared for the dreaded OSHA or EPA inspector & pass with flying colors!

  • The safety and well-being of your employees, community & the environment

  • Your company will "own" the EHS process which is vital for long term success.
